Pecker revealed in granular detail how Trump worked hand-in-hand with the infamous national tabloid to boost his candidacy and, perhaps far more importantly, simultaneously smear his political opponents with shameful lies and innuendo. We should call it an “election interference” trial going forward. Assistant District Attorney Joshua Steinglass skillfully advanced the election interference theory by structuring his evidentiary points in chronological order within that frame. Trump’s alleged 2020 attempt to overthrow our government distorts perceptions of how serious the charges related to the 2016 election are. How can we call this an election interference trial, they ask, if the election was already over when the 34 alleged document falsification crimes occurred? It is an election interference one and we should say so.

Of the first group of 96 potential jurors who crammed into the courtroom, more than half were immediately excused for saying they could not be fair and impartial. A Manhattan jury also found Trump’s business, the Trump Organization, guilty of tax evasion, although Trump was not personally named in that case. It was Cohen who orchestrated the hush money payments and who pleaded guilty to federal charges of violating campaign finance law, for which he served time in prison. Trump is accused by New York of falsifying business records when he paid Cohen back for the hush money scheme.

The process may take longer than the usual jury selection and the pool of persons questioned will be larger. Donald Trump on Saturday took aim at two likely witnesses in his upcoming New York hush money trial, testing the boundaries of a gag order that prohibits such public statements. The social media post is the latest challenge to the limits of a gag order that forbids Trump from making public statements about likely witnesses and jurors. In the weeks since, Trump has repeatedly gambled on the limits of the gag order. It would not be the first time Trump has faced consequences for disobeying a gag order. In a separate trial in October, Judge Arthur Engoron fined Trump $10,000 for gag order violations.
